EARGUIDE TERMS AND CONDITIONS

These terms govern your use of EarGuide. By downloading an EarGuide app, creating an account or making a purchase, you agree to them. Please read them together with our Privacy Policy.

1. WHO WE ARE AND WHAT THESE TERMS COVER

EarGuide is operated by Earguide (“we”, “us”). You can reach us at support@earguide.app.

These terms apply to the EarGuide mobile apps published for each city (for example EarGuide Valencia or EarGuide Peñíscola), to the content inside them and to the website www.earguide.app.

2. THE SERVICE

EarGuide offers self-guided audio tours: audio, text, images and maps about the places you visit, played on your own phone at your own pace.

The content is informational and for leisure. It is not professional advice and does not replace official signage, warnings or instructions from local authorities.

You are responsible for your own safety while walking. Pay attention to traffic, terrain, weather and other people, and pause the tour whenever your surroundings need your full attention. Do not use the app while driving or cycling.

Navigation guidance is provided on a best-effort basis. Location features depend on your device, its GPS signal and the permissions you grant, and may be inaccurate or unavailable, especially indoors or between tall buildings.

3. ACCOUNTS

You can use most of EarGuide without an account. Signing in with Apple, Google or an email address is optional and lets us link your purchases and progress to you.

You must be at least 13 years old to create an account, and you may hold only one account per person. Keep your sign-in details safe: you are responsible for what happens under your account.

You can delete your account at any time from inside the app or by following the steps on our account deletion page.

4. PURCHASES

Each city is unlocked with a one-time in-app purchase, processed by the Apple App Store or Google Play. The price is shown in the store before you buy, in your local currency and including any applicable taxes.

Payments, receipts and refunds are handled by the store under its own policies. To request a refund, use the App Store or Google Play refund process; we cannot issue refunds directly.

Your purchase is tied to your store account, so you can restore it on another device. Family Sharing, where available, follows the rules of the store.

We may make free content paid or paid content free in the future. This does not affect content you have already bought.

5. LICENCE AND INTELLECTUAL PROPERTY

The audio, text, images, maps, software and design of EarGuide belong to us or to our licensors and are protected by copyright and other intellectual property laws.

We grant you a personal, non-exclusive, non-transferable licence to use the content inside the app for your own, non-commercial use. You may not:

6. ACCEPTABLE USE

Use EarGuide only as intended and in accordance with the law. In particular, do not:

We may suspend or close accounts that breach these terms.

7. AVAILABILITY AND CHANGES TO CONTENT

We work to keep EarGuide available, but we do not guarantee uninterrupted service. Downloaded tours work offline; other features need an internet connection.

We may update, correct, add or remove content and features at any time, for example when a place changes or a route becomes unavailable. Historical and cultural information is researched carefully, but accuracy is best effort and we cannot guarantee that it is complete or error-free.

8. LIABILITY

EarGuide is provided “as is”. We give no warranties beyond those required by law.

To the extent permitted by law, we are not liable for indirect losses, or for damage, injury or loss arising from your use of the app while moving around a city, from inaccurate location data, or from changes in the places described.

Nothing in these terms excludes or limits our liability for fraud, for death or personal injury caused by our negligence, or for any liability that cannot be excluded by law. If you are a consumer, nothing here affects your statutory rights.

9. PRIVACY

How we handle your personal data is explained in our Privacy Policy, which forms part of these terms.

10. CHANGES TO THESE TERMS

We may update these terms from time to time. The date at the top shows when they were last changed. We will publish the new version on this website and, for material changes, let you know in the app or by email if you have an account. If you keep using EarGuide after the changes take effect, you accept the new terms.

11. GOVERNING LAW AND DISPUTES

These terms are governed by the laws of Spain. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you may bring a claim before the courts of that country.

If you have a problem, please contact us first and we will try to resolve it informally. Consumers in the European Union may also turn to an alternative dispute resolution body in their country. The European Commission’s online dispute resolution (ODR) platform was discontinued in July 2025 and is no longer available.
